These Terms & Conditions (“Terms”) constitute a binding legal agreement between you and PBAJ Collective (“PBAJ,” “we,” “us,” or “our”). By accessing our website, purchasing merchandise, attending events, participating as a vendor or contributor, or engaging with PBAJ Collective in any capacity, you agree to be bound by these Terms.

If you do not agree, do not access or use our services.

1. GENERAL TERMS (ALL USERS)

1.1 No Reliance / No Counseling Disclaimer

All content, teaching, prophetic expression, and communication provided by PBAJ Collective is for inspirational, educational, and faith-based purposes only. PBAJ does not provide medical, psychological, legal, financial, or professional counseling. You acknowledge that you do not rely on PBAJ content as a substitute for licensed professional advice.

1.2 Assumption of Risk

You voluntarily assume all risks associated with participation in PBAJ activities, including events, merchandise use, and digital engagement, except where prohibited by law.

1.3 Limitation of Liability

To the fullest extent permitted by New Jersey law, PBAJ Collective shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of services, events, or merchandise.

1.4 Force Majeure

PBAJ shall not be liable for delays, cancellations, or failures caused by events beyond reasonable control, including acts of God, illness, government action, venue issues, or technical failures.

2. DISPUTE RESOLUTION

2.1 Mandatory Arbitration

Any dispute arising out of or relating to these Terms shall be resolved exclusively by binding arbitration administered under the rules of the American Arbitration Association. Arbitration proceedings shall be conducted in New Jersey unless otherwise required by applicable federal law.

2.2 Class Action Waiver

You waive any right to bring or participate in class actions, collective actions, or representative proceedings.

2.3 Severability & Survival

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force. All provisions relating to liability, arbitration, indemnification, and intellectual property shall survive termination.

3. MERCHANDISE TERMS

All merchandise sales are final except for defective or incorrect items reported within seven (7) days of delivery. Merchandise may be fulfilled by third-party providers. Delivery times are estimates and not guaranteed.

4. VENDOR TERMS

Vendors operate as independent contractors and bear sole responsibility for products, services, compliance with laws, taxes, permits, and representations. Vendors agree to indemnify and hold harmless PBAJ Collective from any claims arising from vendor participation. PBAJ reserves the right to approve, deny, or terminate vendor participation at its sole discretion.

5. CONTRIBUTOR / VOICE TERMS

Contributors retain ownership of original content but grant PBAJ Collective a perpetual, royalty-free, worldwide license to record, publish, distribute, and promote content and likeness. Participation does not create employment or guarantee compensation unless agreed in writing.

6. EVENT MEDIA RELEASE

Attendance or participation in any PBAJ Collective event constitutes consent to photography, audio recording, video recording, and use of such media for promotional, archival, and commercial purposes without compensation.

7. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the United States, and to the extent state law applies, the laws of the State of New Jersey, without regard to conflict-of-law principles.
